This privacy policy (“Policy”) describes how Prana PR Private Limited (“Company”, “we”, “us” or “our”), which owns, operates and maintains the AI-powered media intelligence software-as-a-service platform named ‘Sentry.ai, powered by Kalki.ai’ (or by whatever name called in the future), together with its website at www.pranapr.com (together, the “Platform”), collects, uses, discloses, retains and protects personal data in connection with the software-as-a-service offering provided through the Platform (“Services”).

By accessing the Platform and/or using the Services, you freely, specifically, in an informed manner, unambiguously and unconditionally agree to the access, collection, processing, storage, use and/or disclosure of your personal data (including YouTube Data, as defined below) in accordance with this Policy. You may, at your sole discretion, choose to withdraw this consent by intimating us of such withdrawal in writing to the contact details set out herein below or by such other mechanism that we may notify from time to time. However, you acknowledge that if you opt out, we may not be able to provide you the relevant Service(s).

We use YouTube API Services to access and use your YouTube Data (as defined below) for the purposes set out in this Policy. Our use of YouTube API Services in connection with the Services is separately and specifically addressed in paragraph 9 below.

Capitalised terms used but not defined in this Policy shall have the meaning ascribed to them in our Terms of Use, available at www.pranapr.com/terms-conditions/.

  1. What Personal Data Do We Collect?

We may collect personal data from you in various forms, including:

  • information you provide while subscribing to, registering for, or using / accessing the Services, or while visiting our Platform. Information collected from you could include details such as your full name, email address, contact number, etc.;
  • information / material posted or submitted by you on the Platform;
  • your responses to online surveys conducted by us;
  • information / material contained in your communications with us, whether by email, through the Platform, or otherwise;
  • billing and payment related information as may be applicable in the context of availing Services; and
  • information in relation to your computer or mobile device including your IP address, geographical location, browsing information, search queries, email address, page view, website navigation etc.

We may also collect, use and share aggregated, de-identified and anonymised data (including “Structured Data” as defined in our Terms of Use), which does not, by itself or in combination with other information reasonably available to us, identify you.

Unless you inform us otherwise in writing, you represent and warrant that: (a) all information furnished by you is accurate and authentic; (b) you are not impersonating any other individual; (c) you are of legal age and have the capacity to enter into a binding agreement; and (d) you have not suppressed, and will not suppress, any material information.

  1. What Is the Purpose for Our Collection of Personal Data?

We collect and process your personal data for the following purposes:

  • to verify your identity and create / administer your profile or access credentials on the Platform;
  • to provide the Services you have chosen to avail;
  • to process and respond to your queries, feedback and support requests;
  • to raise invoices and process payment of Fees;
  • to communicate with you regarding the Services, including updates, notices and changes to our policies;
  • to conduct market research, surveys and analytics regarding usage of the Platform, and to improve the Platform, the Services, and user experience;
  • to enforce our Terms of Use and this Policy, and to protect the rights, property and safety of the Company, its users and others; and
  • to comply with applicable law, regulatory requirements, and requests from courts, regulators or other public authorities.
  1. How Do We Use, Process and Share Your Personal Data?

Internal use: Your personal data may be accessed by our employees, officers and personnel for the purposes set out in this Policy.

Processing personal data: We process your personal data for the purposes of delivering the Services and to facilitate your use of the Platform (including addressing your concerns or queries around the use of both). Anonymised data in the form of statistical analysis of your browsing history or use patterns may be obtained in the context of improving the Platform or Services. However, this data does not identify you. We shall update this Policy from time to time to capture any additional processing that may be performed by us.

Sharing of personal data: We may share your personal data with our Subcontractors (as defined in our Terms of Use) for the purposes of providing Services. We may also disclose your personal data to government authorities, courts, regulators, law enforcement agencies, or other public authorities, where required by applicable law, or in connection with actual or prospective legal proceedings, or to protect the rights, property or safety of the Company, its users or others. In the event of a merger, acquisition, restructuring, or sale of all or substantially all of our assets, your personal data may be transferred to the acquiring or successor entity, subject to that entity’s undertaking to protect such data in a manner consistent with this Policy.

  1. Do We Use Cookies or Similar Technologies?

The Platform may place, access or recognise cookies or similar tracking technologies on your device or browser, to recognise your computer on connection to the Platform, to understand your general usage patterns, to improve site performance, and to make the Platform more user-friendly. All data collected through cookies is protected from unauthorised access by third parties.

If you wish to refuse cookies, you may do so by enabling the relevant setting on your web browser, which will prevent the download of cookies to your browser or device; however, this may affect your ability to use certain features of the Platform or Services.

  1. Till When Do We Retain Your Personal Data?

Your personal data will be retained by us only for so long as is necessary to fulfil the purpose of processing set out in this Policy, unless you withdraw your consent or request erasure of your personal data, or unless a longer retention period is required or permitted under applicable law.

Your personal data will be deleted upon the earlier of: (a) your withdrawal of consent or request for erasure of your personal data; (b) termination or expiry of the Services in accordance with our Terms of Use; or (c) where retention is no longer required or permitted under applicable law.

  1. What Are Your Rights and How Can You Exercise Them?

You have the following rights (among other rights) in connection with your personal data:

  • the right to withdraw your consent for processing of your personal data;
  • the right to request the Company for: (i) a summary of the personal data processing and processing activities undertaken by the Company; and (ii) identities of all other parties with whom your personal data has been shared;
  • the right to request correction, completion, updating or erasure of your personal data; and
  • the right to seek redressal of your grievances in connection with processing of your personal data by us.

If you wish to exercise any of the above rights, please write to us with your specific request (along with the reasons) at the contact details set out in this Policy.

If you are not satisfied with our redressal of your grievances or requests, you may approach the appropriate regulatory authority for data protection matters in India, through such mechanism as may be notified by the relevant authorities from time to time.

While exercising any of your rights above, please ensure that you: (a) do not impersonate another person; (b) do not suppress any material information; (c) do not register any false or frivolous grievance or complaint; and (d) furnish only such information which is verifiably authentic.

  1. How Do We Keep Your Data Secure?

We implement appropriate physical, electronic and managerial security practices and procedures, commensurate with applicable industry standards and provisions of applicable law, to protect the personal data in our possession. We strive hard for ensuring that your personal data held by us is protected from misuse, loss and unauthorized access, modification or disclosure. We do not, however, assume liability for disclosure arising from errors in transmission, unauthorised third-party access, or other causes beyond our reasonable control.

  1. Do We Use Third-Party Links?

The Platform may contain links to third-party websites. Such links do not constitute an endorsement or recommendation by us, and we have no control over, and accept no responsibility for, the content, privacy practices or terms of such third-party websites. Your interactions with such websites are solely at your own risk and subject to their respective policies.

  1. Our Use of YouTube API Services

This paragraph separately and specifically addresses our use of YouTube API Services in connection with the Services.

Disclosure of use: We use, and by accessing the Platform and/or using the Services you agree to our usage of, YouTube API Services to fetch your publicly available data on YouTube (which includes video title, tags, category, video statistics, channel name, channel ID, profile information, thumbnails, playlist content and associated metadata) (“YouTube Data”) to directly (or through third-party integration) create dashboard features and provide AI-powered analytics which include (without limitation) advanced metrics, content insights, AI summaries, performance predictions, optimization suggestions, trend analysis, and content recommendations.

Acceptance of YouTube and Google terms of service:  Our and your rights and obligations in relation to the use of YouTube API Services for facilitation of Services under the Terms of Use and this Policy is governed by the YouTube API Services Terms of Service available at https://developers.google.com/youtube/terms/developer-policies#d.-accessing-youtube-api-services. By agreeing to the Terms of Use and this Policy and/or using features that interact with YouTube API Services, you also agree to be bound by YouTube Terms of Service (available at https://www.youtube.com/t/terms) and Google Privacy Policy (available at https://www.google.com/policies/privacy) in connection with our use of YouTube API Services for the Services under the Terms of Use and this Policy.

Access / collection of YouTube Data: Depending on your permissions and interactions with the Platform, YouTube Data that we may access, collect, store and use includes:

  • video title, description, tags and category;
  • video statistics, including views, likes and comment counts;
  • channel name, channel ID and profile information;
  • thumbnails and associated metadata; and
  • playlist content and metadata.

Unless you specifically authorise us to do so, we do not access, collect or store your private data on YouTube, including private videos, private playlists, sensitive account details, or your passwords / authentication tokens.

Usage of YouTube Data: We use your YouTube Data strictly for the following purposes:

  • AI-based enrichment: we send non-personal, publicly available YouTube video content (titles, descriptions, tags and statistics) to OpenAI, through its API, to generate advanced metrics, content insights, AI summaries, performance predictions and optimisation suggestions; in each case, used only to improve your analytics and dashboard experience; and
  • Analytics and dashboard features: your YouTube Data is used to display insights within the Platform, create user dashboards, provide trend analysis, and generate content recommendations.

We do not use YouTube Data for personalised advertising, selling or renting data, background data extraction unrelated to the Services, unauthorised data transfers, or cross-service profiling unrelated to the Services.

Sharing of YouTube Data: We do not sell or rent your YouTube Data to any third party, except to the following:

  • OpenAI, to generate AI-based insights from your YouTube Data;
  • infrastructure service providers (such as cloud hosting and computing providers), who receive only the minimum YouTube Data necessary to provide the Services; and
  • legal authorities, only if required by applicable law.

We do not share your YouTube Data for marketing or advertising purposes.

Storing of YouTube Data: We may store non-personal, publicly available YouTube video metadata to maintain dashboards, improve load times and generate historical insights, for no longer than is reasonably necessary for such purposes. Unless you specifically authorise us, we do not store your private data on YouTube.

Revocation of access to YouTube Data: You may revoke our access to your YouTube Data at any time through Google’s security settings page (available at https://security.google.com/settings/security/permissions). Once revoked, we will no longer access new YouTube Data associated with your YouTube account.

Deletion of YouTube Data: You may request deletion of any of your YouTube Data stored by us, by writing to us at the contact details set out herein below or by such other mechanism that we may notify from time to time.  Upon receipt of such request, we will delete the relevant YouTube Data within a reasonable period, save to the extent we are required to retain it under applicable law.

  1. Updates to This Policy

We may amend or modify this Policy from time to time, at our sole discretion, including to reflect changes in our data processing practices or to ensure compliance with applicable law. Material changes shall be communicated to you through an email update, by posting the updated Policy on the Platform, or through such other mode of communication as we may deem appropriate. Your continued use of the Platform following any such update constitutes your acceptance of the amended Policy.

  1. Governing Law

This Policy shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with this Policy shall be subject to the dispute resolution mechanism (including the arbitration and jurisdiction provisions) set out in our Terms of Use.
